※취약계층의 범위

(사회적기업 육성법 시행령 제2조)자신에게 필요한 사회서비스를 시장가격으로 구매 하는데 어려움이
있거나 노동시장의 통상적인 조건에서 취업이 특히 곤란한 계층

1. 가구 월 평균소득이 전국 가구 월 평균 소득의 100분의 60 이하인 사람

2. ｢고용상 연령차별금지 및 고령자고용촉진에 관한 법률｣ 제2조제1호에 따른 고령자

3. ｢장애인고용촉진 및 직업재활법｣ 제2조제1호에 따른 장애인

4. ｢성매매방지 및 피해자 보호 등에 관한 법률｣ 제2조제1항제4호에 따른 성매매 피해자

5. ｢청년고용촉진 특별법｣ 제2조제1호에 따른 ʻ청년ʼ 중 또는 ｢경력단절여성등의 경제활동 촉진법｣
제2조제1호에 따른 ʻ경력단절여성등ʼ 중 ｢고용보험법 시행령｣ 제26조제1항에 따른 고용촉진
장려금의 지급대상이 되는 사람

6. ｢북한이탈주민의 보호 및 정착지원에 관한 법률｣ 제2조제1호에 따른 북한이탈주민

7. ｢가정폭력방지 및 피해자 보호 등에 관한 법률｣ 제2조제3호에 따른 피해자

8. ｢한부모가족지원법｣ 제5조 및 제5조의2에 따른 보호대상자

9. ｢재한외국인처우지원법｣ 제2조제3호에 따른 결혼이민자

10. ｢보호관찰 등에 관한 법률｣ 제3조제3항에 따른 갱생보호대상자

11. 다음 각 목의 어느 하나에 해당하는 사람
가. ｢범죄피해자 보호법｣ 제16조에 따른 구조피해자가 장해를 입은 경우 그 구조피해자 및 그 구조 피해자와 생계를 같이 하는 배우자, 직계혈족 및 형제자매
나. ｢범죄피해자 보호법｣ 제16조에 따른 구조피해자가 사망한 경우 그 구조피해자와 생계를 같이하던 배우자, 직계혈족 및 형제자매

12. 그 밖에 고용노동부장관이 취업 상황 등을 고려하여 ｢고용정책기본법｣ 제10조에 따른 고용정책 심의회의 심의를 거쳐 취약계층으로 인정한 사람
가. 1년 이상 장기 실업자
나. ｢형의 집행 및 수용자 처우 등에 관한 법률｣에 따른 수형자로서 최초 고용 시 출소 후 6월이 경과되지 아니한 자(단, 노역유치자는 제외)
다. ｢보호 청소년 등의 처우에 관한 법률｣에 따른 소년원생로서 최초 고용 시 퇴원 후 6월이 경과되지 아니 한 자
라. ｢보호관찰 등에 관한 법률｣에 따른 보호관찰 청소년(보호관찰기간 중인 자)
마. 노숙인
바. 약물･알코올･도박중독자
사. 선천성 또는 희귀난치병 치료자(질병관리본부․국민건강보험공단 희귀난치성 질환목록확인)
아. 여성실업자 중 가족부양책임이 있는 자(여성가장)
자. 난민 (난민법에 따라 난민 인정을 받은 자)
* 단, 사회서비스대상 취약계층은 위 취약계층 및 조손가정, 외국인근로자, 금융채무불이행자 및 저신용자, 학교폭력피해자, 학교밖청소년, 중증질환자 등 포함
차. 보호종료아동
