Ⅰ. 설립절차
1. 발기인 구성: 5인 이상
2. 정관 작성: 발기인이 작성(발기인 전원 기명날인, 간일)
3. 설립동의자 모집: 발기인에게 설립동의서 제출(모집하지 않을 수 있음)
4. 창립총회 공고: 창립총회 개최 7일 전(공고일 제외)까지
5. 창립총회: 설립동의자 과반수 출석 및 출석자 ⅔ 찬성으로 의결 / 의사록 작성
6. 설립신고: 주사무소 소재지 관할 시·도지사에 신고 / 신고확인증 발급(20일 이내)
7. 사무 인계: 발기인 → 이사장
8. 출자금 납입: 이사장 명의의 통장
9. 설립등기: 주사무소 소재지 관할 등기소, 출자금 납입 완료일로부터 14일 이내
10.사업자등록: 주사무소 소재지 관할 세무서, 사업 개시일로부터 20일 이내

Ⅱ. 설립신고 서류
1. 설립신고서: 시행규칙 별지 제2호 서식
2. 정관 사본: 정관 원본에 발기인 전원이 기명날인 및 각 장마다 간인후 복사본에 원본대조필 날인
3. 창립총회 개최 공고문: 주사무소에 게시한 사진 또는 메일·우편 발송문 첨부
4. 창립총회 의사록 사본: 원본에 의장 및 총회에서 선출된 조합원 3인 이상 기명날인 및 각 장마다 간인 후 복사본에 원본대조필 날인
5. 임원 명부: 시행규칙 별지 제3호 서식
6. 사업계획서: 시행규칙 별지 제4호 서식
(*4/4분기 설립신고시에는 다음해 사업계획서도 제출을 요구받을 수 있으니 해당 설립신고처에 사전에 확인 바랍니다)
7. 수입·지출 예산서: 시행규칙 별지 제5호 서식
8. 출자 1좌당 금액과 출자좌수를 적은 서류
9. 발기인 및 설립동의자 명부: 시행규칙 별지 제6호 서식
10. 합병 또는 분할을 의결한 총회 의사록 사본
※합병 또는 분할로 인하여 설립되는 경우만 해당하며, 합병 또는 분할로 인하여 존속하거나 설립되는 협동조합이 승계하여야 할 권리 및 의무의 범위가 의결사항으로 기재되어야 함

1. 설립등기신청서
2. 정관(사본) : 원본대조필 날인(원본지참 필수)
3. 창립총회 의사록 : 공증 받은 원본을 제출
4. 설립신고확인증
5. 임원 취임승낙서(인감도장 날인), 인감증명서, 주민등록등(초)본
※ 임원 전원의 서류를 제출하여야 하며, 법인이 임원인 경우에는 법인의 취임승낙서(법인인감도장날인), 법인인감 증명서와 법인등기부등본 제출
6. 인감신고서, 인감대지 3매
7. 출자금 총액 납입증명서
※ 금융기관이 작성한 잔고증명서나 이사장이 발행한 출자금납입확인서 등 모두 가능하며, 현물출자가 있는 경우 현물출자재산인계서 또는 출자재산영수증을 함께 제출
8. 등록면허세 영수필 확인서 : 서울지역에서 협동조합 설립시에는 서울시지방세 인터넷납부시스템(etax.seoul.go.kr) 에서 세금 납부 후 영수증을 출력하는 것을 권장
9. 위임장 : 대리인이 신청할 경우
10. 합병이나 분할로 인한 설립시 채권자 보호절차를 종료 하였음을 증명하는 서류

Ⅵ. 사업자등록
1. 법인설립신고 및 사업자등록신청서
2. 정관 사본(원본대조필 날인)
3. 법인등기부등본
4. (법인명의) 임대차계약서 : 사업장을 임차한 경우
5. 주주 또는 출자자명세서 : 조합원 출자명세서
6. 사업허가·등록·신고필증 사본 : 해당 법인에 한함. 허가(등록, 신고)전에 등록하는 경우 허가(등록)신청서 등 사본 또는 사업계획서
7. 자금출처명세서 : 금지금 도·소매업 및 과세유흥장소의 영업을 영위하려는 경우
8. 현물출자명세서 : 현물출자법인의 경우에 한함
9. 위임장 : 대리인이 신청할 경우
